Terms and Conditions

APPLICATION

1.0 These General Terms and Conditions apply to all offers, reservations, and agreements relating to all accommodations and other facilities that are rented by Delynne Boutique Hotel or third-party platforms and affiliated businesses booked through them.

1.1 In these General Terms and Conditions, the term ‘tenant’ is understood to mean: the person who concludes an agreement with Delynne Boutique Hotel regarding the rental/use of accommodation. The term ‘user’ is understood to mean: the tenant and the persons specified by the tenant who (will) use the accommodation rented by the tenant and/or other facilities.

1.2 These General Terms and Conditions apply regardless of any (prior) reference to any other terms and conditions or to other general terms and conditions. Delynne Boutique Hotel rejects any other Terms and Conditions that one might refer to but are not set up by Delynne Boutique Hotel.

1.3 Agreements deviating from these General Terms and Conditions are only valid if agreed upon in writing.

RESERVATION

2.0 Delynne Boutique Hotel only handles reservations from individuals who are 21 years of age or older. Reservations by persons younger than that age are therefore not valid.

2.1 Delynne Boutique Hotel takes reservations from 1 night onward.

2.2 If Delynne Boutique Hotel processes your reservation, Delynne Boutique Hotel will send you a written confirmation, as well as an invoice + payment link within 14 days after the reservation has been made.

2.3 In order to make a reservation or if you made a reservation on our website or through OTA channels, you are required to pay a non-refundable deposit of $100 to confirm your reservation.

2.4 If you have not received a written confirmation/invoice within 14 days of making the reservation, you must contact the reservations department without delay; if you fail to do so, the reservation cannot be invoked.

2.5 An agreement is concluded between you and Delynne Boutique Hotel at the moment that Delynne Boutique Hotel has also sent the written confirmation of your reservation to you, as well as the invoice.

2.6 The agreement concerns the rental of accommodations and/or other facilities for recreational use, which by its nature is of short duration.

CHANGES TO THE AGREEMENT

3.0 If, after the conclusion of the agreement, you wish to make changes to the agreement, Delynne Boutique Hotel is not obliged to accept them. It is Delynne Boutique Hotel’s free choice to determine whether and to what extent these changes are accepted. In case Delynne Boutique Hotel accepts your changes, a change fee may apply.

SUBSTITUTION

4.0 The entrepreneur, the tenant, and/or other users are not permitted to hand over the accommodation under any name whatsoever and for whatever reason to others than the persons mentioned in the agreement unless otherwise agreed in writing with Delynne Boutique Hotel.

4.1 If you and Delynne Boutique Hotel have agreed that you and/or one or more users will be replaced, in addition to the tenant and/or users who replace you and/or other users, you remain jointly and severally liable to Delynne Boutique Hotel for the payment of the part of the rent still due, the change costs (see Article 3.0), and any additional costs resulting from the replacement and any cancellation costs.

RATES

5.1 You owe Delynne Boutique Hotel the agreed rental price, as stated in the written confirmation and invoice of the reservation. If the costs of Delynne Boutique Hotel (personnel, energy, taxes, etc.) have demonstrably and unforeseeably increased after the conclusion of the agreement, Delynne Boutique Hotel has the right to increase its prices and charge you the increased price. If this price increase is implemented within 3 months after the agreement has been concluded, the increase will amount to a maximum of 5% of the previously agreed price, and you will have the right to dissolve (cancel) the agreement on that ground.

5.2 Price discounts and/or special offers can no longer be used if the confirmation of the reservation/invoice has already been sent by Delynne Boutique Hotel.

EXTRA COSTS

6.0 In addition to the rent, the tenant owes any applicable taxes, such as turnover tax and contributions to other levies.

PAYMENTS

7.0 A $100 non-refundable deposit is required to confirm your reservation. Payment of this amount must be made within 14 days after the date of the confirmation/invoice of the reservation with Delynne Boutique Hotel. This deposit will be deducted from the total rental amount.

7.1 The full amount of the rent must be received by Delynne Boutique Hotel no later than 2 days before the start of the stay as stated in the reservation confirmation. A payment link will be sent for the full amount of the stay. Guests who fail to pay for their stay 2 days prior to arrival will not be allowed to check in (“no pay, no stay”).

7.2 When booking within 2 days before the start of your stay, the entire reservation amount must be paid immediately upon reservation.

7.3 In case of late payment, you will be in default immediately after the payment period expires. In this case, Delynne Boutique Hotel reserves the right to dissolve (cancel) the agreement and charge cancellation costs, as outlined in the cancellation policy.

7.4 Payments by credit card are possible. A 3% bank fee will be charged for this. This is referred to as “Resort Fee.”

7.5 All reservations require a deposit of $100 (non-refundable) to confirm the reservation. The payment link will be sent on the day of the reservation request.

ARRIVAL AND DEPARTURE

8.0 The rented accommodation can be occupied on the agreed day of arrival as stated on the confirmation of the reservation, from 2 pm onward. On the agreed day of departure as stated on the confirmation of the reservation, the accommodation must be vacated by 11 am.

8.1 If you wish to extend your stay beyond the agreed duration and Delynne Boutique Hotel agrees to this, the hotel reserves the right to designate another accommodation.

8.2 If the use of the accommodation and/or other facility is terminated earlier than on the agreed date as stated on the confirmation of the reservation, the tenant is not entitled to a refund of (part of) the rental price and/or costs unless explicitly agreed otherwise.

8.3 Delynne always has the right to terminate the agreement with immediate effect, if personal data of you and / or other users are provided incompletely and / or incorrectly when booking. In such a case, no refund will be made of the rent or part thereof.

REGULATIONS

9.0 All guests must adhere to the rules established by Delynne Boutique Hotel, which include but are not limited to the Resort Regulations and Swimming Pool Regulations. These regulations will be provided upon arrival or can be requested at any time.

9.1 Guests are required to present valid identification at check-in. Failure to do so may result in the cancellation of the reservation without a refund.

9.2 Each accommodation may only be occupied by the number of people specified in the reservation. Violation of this rule may result in eviction without a refund.

9.3 Smoking is strictly prohibited inside the accommodations. Designated smoking areas are provided on terraces or balconies.

9.4 Guests must report any room-related complaints or issues immediately upon discovery to allow staff to address the matter promptly.

9.5 The tenant must leave the accommodation broom-clean upon departure. Failure to do so will result in additional cleaning charges.

9.6 Complaints related to damage or misuse caused by the guest will not be eligible for room changes or refunds. The client will also forfeit their deposit in such cases.

9.7 In case of violation of the rules, Resort regulations and / or Swimming pool regulations included in these General Terms and Conditions and / or in Regulations not following instructions from the staff, DeLynne has the right to immediately remove you, the tenant and any other user from the Resort, without refund of the rent or part thereof.

LIABILITY

10.1 Delynne Boutique Hotel accepts no liability for theft, loss, or damage of or to goods or persons, of whatever nature, during or as a result of the stay at the resort and/or the rental/use of the accommodation, unless caused by intent or gross negligence of Delynne or its employees.

10.2 Liability for consequential damages, including but not limited to loss of travel enjoyment or business, is excluded. Guests must rely on travel or cancellation insurance for such claims.

10.3 Delynne Boutique Hotel is not liable for malfunctions or defects in services provided by third parties

10.4 Guests are jointly and severally liable for all loss and/or damage to the property of Delynne caused by themselves or their party during their stay.

10.5 Guests indemnify Delynne against all claims from third parties arising from their actions, omissions, or those of their party.

10.6 Improper use or abandonment of the property, including excessive pollution, will result in additional charges, which must be paid immediately.

 FORCE MAJEURE

11.0 Delynne Boutique Hotel is not responsible for failure to fulfill its obligations due to force majeure, including natural disasters, pandemics, or government regulations.

COMPLAINTS

12.0 Complaints must be reported immediately to resort management for resolution.

12.1 If unresolved, written complaints must be submitted within 14 days of departure to the management team.

CANCELLATION

  • General Cancellation Policy:
    • A full refund is available for cancellations made within 48 hours of booking, provided the check-in date is at least 14 days away.
    • A 50% refund is applicable for cancellations made at least 7 days before the scheduled check-in date.
    • No refunds will be issued for cancellations made within 7 days of the check-in date.
  • Short-Stay Cancellation Policy (27 or Fewer Consecutive Nights):
    • To receive a full refund, guests must cancel at least 30 days before check-in.
    • If guests cancel between 7 and 30 days before check-in, we will charge 50% of the total cost for all nights.
    • If guests cancel less than 7 days before check-in, we will charge 100% of the total cost for all nights.
    • Guests can also receive a full refund if they cancel within 48 hours of booking, provided the cancellation occurs at least 14 days before check-in.
  • Long-Stay Cancellation Policy (28 or More Consecutive Nights):
    • To receive a full refund, guests must cancel at least 30 days before check-in.
    • If a guest cancels after that, we will charge 100% for all nights stayed, plus an additional 30 nights.
    • If fewer than 30 nights remain on the reservation when the guest cancels, we will charge 100% for all of those remaining nights.
  • Cancellation Policy After Check-In:
    • No refunds will be issued after check-in.
  • No Show and Cancellation Policy:
    • Failure to arrive within 24 hours of the agreed-upon check-in date without prior notice will be considered a No Show, and 100% of the total costs, including taxes and service fees, will be charged.
  • Group Reservation Cancellation Policy (2 or More Apartments):
    • Guests must cancel at least 60 days before check-in to receive a 50% refund for all nights.
    • Cancellations made fewer than 60 days before check-in will be charged 100% of the total costs for all nights.

 APPLICABLE LAW

13.0 These terms are governed by Curaçao law. Disputes will be resolved in Curaçao courts.

FINAL PROVISIONS

14.0 Delynne Boutique Hotel reserves the right to amend these Terms and Conditions at any time, with immediate effect for future reservations.
